As Lockout Drags On, Owners’ Resolve Could Be Tested

Six days into the N.H.L. lockout, the first week of preseason games has been canceled, some teams have announced temporary layoffs and the league office has reduced its employees’ workweeks and salaries.

Training camps were to open Friday, but instead many players have signed with European clubs or were sent to minor league affiliates. With no formal talks between the league and its players union since Sept. 13 and none scheduled, the N.H.L. appears to be headed for a lengthy lockout.

The general assumption is that the owners have the resources to wait it out, and that the players have no real leverage. Presumably, they will have to accede to some version of the owners’ demand that they accept substantially less than the 57 percent of league revenue they received the last seven years.

But are there pressure points acting on the owners that might induce them to settle for a deal more quickly?

The potential pressure points include the Winter Classic, the extravagant Jan. 1 outdoor game and NBC telecast that has proved vitally important to the N.H.L.’s visibility, and the need to avoid further financial disruption for the estimated 16 to 18 money-losing teams.

The owners also must consider the implicit threat that if they are too inflexible, Donald Fehr, the union’s executive director, might put the N.H.L.’s salary-cap system on the bargaining table.

Fehr said last week that if there was a significant lockout with no movement in negotiations, “the players are as free to reconsider their position as the owners.”

The players’ association is hoping that enough owners of money-losing teams will push Commissioner Gary Bettman to accept some version of the union’s offer, which includes an expanded revenue-sharing plan among N.H.L. clubs designed to benefit struggling franchises like the Panthers, the Blue Jackets and the Islanders.

But last week Bettman said that the owners had given him unanimous support for the lockout. In the season-long 2004-5 lockout, Bettman kept all the owners together, enabling them to force the players to accept a 24 percent pay cut and the imposition of a salary cap.

“When you have 30 votes and you’ve got strong leadership, really the deal is going to get done with the macro perspective — what is best for the league and what is the right deal for the game and for the industry,” said Ed Horne, chief operating officer at the agency Madison Avenue Sports and Entertainment and, during the last lockout, president of N.H.L. Enterprises.

Horne sees Bettman’s leadership and the overriding self-interest of the owners as a whole, as factors promoting solidarity among the owners.

“While clearly there will always be different situations for different teams in different markets, I believe the deal that ultimately gets done is the one that benefits the overall group,” Horne said.

One way Bettman keeps the owners unified is by wielding the threat of a $1 million fine against any owner who speaks publicly on labor matters. Last week the Buffalo Sabres’ owner, Terry Pegula, declined to answer a reporter’s question about the lockout.

“I can’t tell you anything, just that talks continue — I don’t want to lose draft picks,” Pegula said, laughing.

For that innocuous remark, the Sabres received a warning telephone call from the league office.

Many believe that the owners’ resolve will be tested in December, when pressure mounts to return to play ahead of the Winter Classic on Jan. 1.

The five previous Winter Classic games, all carried by NBC, were the five most-watched regular-season hockey games in North America since the 1970s. Including corporate sponsorships and merchandise sales, the game generates a profit in the “substantial seven figures,” John Collins, the league’s chief operating officer, said last year.

This season’s game is especially grand in scale. It is to be played at Michigan Stadium in Ann Arbor before a crowd of perhaps 115,000, which would be a world record for hockey. It will involve the Detroit Red Wings and, for the first time, a Canadian club — the Toronto Maple Leafs, the N.H.L.’s most valuable and popular team.

“From a marketing perspective, the Winter Classic is one of the few home runs the N.H.L. has hit,” said Brad Adgate, senior vice president for research at Horizon Media.

Adgate compared the pressure to preserve the Winter Classic with the pressure on N.B.A. owners during last year’s lockout to return in time for that league’s lucrative Christmas Day slate of games. The N.B.A. and its players reached an agreement in late November after a five-month lockout and turned the Christmas schedule into an opening-day bonanza

 

AP Sources: UNC's Roy Williams Has Surgery

North Carolina coach Roy Williams has had surgery to remove a kidney tumor, people familiar with the situation said Wednesday.

Two people spoke to The Associated Press on condition of anonymity because the school has not publicly released any details on Williams. One of the people who spoke to the AP said the severity of the tumor is unknown.

Team spokesman Matt Bowers would only confirm that the 62-year-old Hall of Fame coach had a "medical procedure" Wednesday morning.

The news was first reported by WRAL in Raleigh, N.C.

Williams will open practice next month for his 10th season at his alma mater, where he spent 10 years as an assistant to Dean Smith before taking over at Kansas and leading the Jayhawks to four Final Fours. Williams, who has 675 wins in 24 seasons, won NCAA championships with the Tar Heels in 2005 and 2009.

The Tar Heels have won the Atlantic Coast Conference regular-season title and reached the NCAA regional final the past two seasons.

But those Yankees, we can clearly see, were the exceptions. With less than two weeks to go in this regular season, the big spenders from last winter are all on the outside of the playoff race.

Jose Reyes and the Miami Marlins have been eliminated. The Los Angeles Angels, in their first of 10 years with Albert Pujols, are stuck in third place in races for the American League West and a wild card. The Detroit Tigers, who won the A.L. Central last season without Prince Fielder, trail the Chicago White Sox with him.

In hindsight, maybe it was asking too much to expect multiple championships from Sabathia, Teixeira and Burnett, who was traded to Pittsburgh in February. But by winning it all in their first year together, Sabathia and Teixeira raised expectations, if that was even possible in the Bronx.

Three years after that memorable fall, when Teixeira hit a game-ending homer in the division series and Sabathia was named the most valuable player in the A.L. Championship Series, the Yankees still count on them. But neither, for the moment, is quite the same.

Teixeira has played once since Aug. 27 because of a strained left calf. That appearance, of course, resulted in a game-ending blown call in Baltimore, when Teixeira slid into first base and aggravated the injury. He is headed to Tampa, Fla., on Monday, hoping to play instructional league games before the postseason.

“Just being in game situations, where I leg out a double or I dive in the hole on a ground ball to first base,” Teixeira said. “Those are things I need to do in a real game situation because we can’t try it out in a playoff game and have me blow out right away. That wouldn’t be good for anybody.”

Teixeira knows from experience. In the 2010 A.L.C.S., when he was already dealing with toe and knee injuries, Teixeira popped a hamstring that ended his season. He would not have played in the World Series had the Yankees advanced.

Teixeira is taking no chances with this injury, after already rushing back once. It is surely the smart move, because as much as he has struggled in the postseason as a Yankee — a .170 average in six series — Teixeira’s power can change a game.

Sabathia, who faces Oakland at Yankee Stadium on Friday, has dealt with groin and elbow trouble this season. He has lost three consecutive decisions for the first time as a Yankee, and in each of his last four starts, he has given up a lead the Yankees could not regain.

Sabathia’s velocity has dropped, and he has lost some of his fastball command, which makes his default strategy — pound the zone — tougher to execute. In 2009, according to Fangraphs, Sabathia averaged 94.2 miles an hour with his fastball and threw it 61.6 percent of the time. This season, the pitch averages 92.3 m.p.h., and he uses it just 53.7 percent of the time.

“I have a lot of faith in C. C., that he’ll figure this out and get things righted,” Manager Joe Girardi said. “It’s weird: C. C. goes six, seven innings and gives up three runs, and we say, ‘What’s wrong with C. C.?’ He’s still pitched O.K.; it’s just not what we’ve seen the previous years he’s been here. We need him to get on a roll, and tomorrow would be a good day to start.”

Even a diminished Sabathia is savvy enough to compete. He has gotten at least one out in the seventh inning in each of his last seven starts, with a 3.78 earned run average in that span. Not great, but not terrible, either. With the Yankees’ offense, he still gives his team a chance to win.

The Yankees need Sabathia to do at least that if — and, probably, when — they reach the playoffs. With Sabathia, Hiroki Kuroda and Andy Pettitte, they have a strong top three in the rotation, and Ivan Nova or Phil Hughes can match up with most No. 4 starters.

That presumes a healthy Pettitte, but after his five shutout innings on Wednesday, it seems like a safe bet. Not only did Pettitte pitch well, he showed his usual resourcefulness, an attribute that has helped him, over and over, in Octobers past.

Pettitte is lined up to start the wild-card game if the Yankees are forced to play in it, but whenever he starts in the postseason, he cannot be limited. He will be held to 90 pitches or so on Monday in Minnesota.

“That’s definitely what I’m trying to do, get that pitch count up where it’s not an issue,” Pettitte said. “I think I’ll have a little better idea maybe after this next one. Obviously, there’s not many more after that, but I still don’t know exactly how I’m going to feel, just because I feel like yesterday my legs fatigued a little bit quicker than I thought they would.”

Pettitte was first injured by a line drive, but his slow recovery could almost be expected. The stars of 2009 are three years older, fighting off age and injury for another run at glory.

EADS-BAE talks may spur European drone development

(Reuters) - A merger between EADS (EAD.PA) and Britain's BAE Systems (BAES.L) could strengthen European efforts to develop unmanned ariel drones, after competition between the two firms allowed the United States and Israel to dominate a growing market.

The attacks on the United States of September 11, 2001 ended official skepticism over the value of drones and Airbus maker EADS has spent years and around 500 million euros ($645 million) working on the Talarion drone in the hope of an order from the project's instigators France, Germany and Spain.

But then France's Dassault Aviation (AVMD.PA) and Britain's BAE Systems stepped up plans for their own drone under a Franco-British defence pact signed in 2010, provoking anger and frustration from EADS.

Earlier this year, EADS threw in the towel because it failed to win firm commitments, and the project has been further hampered by a major shake-up at defence unit Cassidian that has included replacing its chief executive.

However, the efforts by Dassault and BAE to build their own drone so far do not seem to have borne much fruit either, with French Defence Minister Jean-Yves le Drian saying this week he had "major reservations" about the plan.

A combination with BAE would give EADS an opportunity to avoid losing more ground in drones, which are becoming more common in areas such as border control, especially in the United States, disaster investigation and protecting oil pipelines.

U.S. forces have become reliant on them for reconnaissance, including in Iraq, and to kill Islamist militants in Afghanistan and Pakistan, despite public outcries over civilian casualties.

Merger talks between BAE and EADS were unveiled late on Wednesday, but it will take months to get any new company structure in place should a deal go through.

Research funding remains an issue too. Years-long talk of developing a European drone has so far failed to produce a finished product, as national governments hesitate to commit to such a project.

The biggest drone manufacturers are in the United States and Israel - such as General Atomics, which makes the Predator, or Heron-maker Israel Aerospace Industries.

Current worldwide spending on unmanned aerial vehicles (UAVs) is $6.6 bln and market researcher Teal Group has estimated that annual spending on them around the world will almost double to $11.4 billion over the next 10 years.

An unarmed drone usually retails at around $3-4 million.

German defence Minister Thomas de Maiziere said last month Germany, which used unmanned aircraft in World War Two, should deploy armed drones in its military.

Aerospace firms, including former EADS boss Louis Gallois, have long called for European countries to pool resources and cooperate on one program.

WHERE'S THE MONEY?

EADS unit Cassidian showcased a reborn Talarion called only European UAS (unmanned aerial system) at the ILA Berlin Air Show this week.

But officials in the German armed forces have pointed out that Talarion would face competition from the U.S. Predator drone, which is widely used in Afghanistan, and Israel's Heron, and have questioned the value of the project.

The biggest challenge remains a lack of concerted investment in Europe, where governments are generally cutting back on defence spending, partly in view of the euro zone debt crisis and the global slowdown, and are wary of big defence projects with spiraling costs and uncertain outcomes.

"Europe is going to get there, but it requires some investment," Teal Group's Phil Finnegan said at the air show just before the EADS-BAE talks emerged. "So far, Europe has really relied on imported technology."

Suppliers in Europe would be at the ready if a new drone ever takes off, but caution that seems unlikely to happen any time soon.

MTU Aero Engines (MTXGn.DE) and Italy's Avio Group agreed earlier this year to explore opportunities related to propulsion systems for medium-altitude long endurance (MALE) UAVs and combat drones.

"This is a move forward to demonstrate here we are, we are prepared to do something, but there is no program, no program in sight to develop a UAV in larger volumes that requires specific engine technology," MTU Chief Executive Egon Behle said at ILA.

And Diehl Defence, which was at one point hoping to be involved in the Talarion project, is still looking at providing weapons capability for any European UAV project.

"There is no research program as such, but we are looking at concepts. It wouldn't be advisable to think about it only when the definitive decision has been taken," Managing Director Claus Guenter said.

EADS CEO Tom Enders said this week he was pretty confident some progress would be made in coming years, but for now the German Bundeswehr plans to start using the Euro Hawk, made by Northrop Grumman and EADS's Cassidian.

The Euro Hawk, which was also on display at the Berlin air show, will make its first test flights in Germany later this year, once it has received the necessary certifications, and Enders said he hoped it would come into use in 2013.

The Bundeswehr has leased three Heron drones, which it is expected to keep until 2014 and is considering buying some U.S.-built Predator B drones, which can carry weapons as well as perform reconnaissance. An alternative could be procurement of the Heron TP.
